Terms of Use

These Terms explain the standards expected from every Develop Jointly user and the important responsibilities that apply when meeting people, forming groups and discussing property or construction developments through the app.

Develop Jointly exists to help people interested in property and development meet, communicate and explore opportunities while maintaining clear standards of conduct and responsibility.

By using Develop Jointly you agree to follow these standards. Please read the Terms carefully before creating an account, communicating with other users or participating in any property or development discussion.

Acceptance of These Terms

By creating an account, accessing Develop Jointly or using any feature of the app, you agree to comply with these Terms of Use and any other policies made available through the app.

If you do not agree with these Terms of Use, you should not use Develop Jointly. Continued use of the app after these Terms are updated means that you agree to the updated Terms.

Purpose of Develop Jointly

Develop Jointly is a networking platform designed specifically to help people with an interest in property, construction and property development meet, communicate, form groups and discuss possible development opportunities.

The platform must not be used as a general-purpose social media service, dating service, friendship or relationship platform, entertainment platform, political platform or for any other purpose unrelated to property, construction or development.

Users must only use the app in a genuine manner that is consistent with its intended purpose.

Respectful Behaviour

Every user is expected to treat other members with respect. Abuse, bullying, intimidation, harassment, stalking, humiliation, threatening behaviour or deliberately hostile conduct will not be tolerated.

Users must not engage in racism, discrimination, prejudice, hate speech or abusive conduct directed at another person or group because of race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability, age or any other personal characteristic.

Threats of violence, threats of harm, encouragement of violence or conduct intended to frighten, intimidate or endanger another person are strictly prohibited.

Prohibited Content

Users may upload photographs, profile images, group images, development images, descriptions, messages and other content through Develop Jointly. Users are responsible for everything they upload, send or publish.

Users must not upload, send, publish, request, promote or distribute content that is illegal, violent, threatening, abusive, hateful, discriminatory, sexually explicit, pornographic, exploitative, fraudulent, defamatory or otherwise seriously offensive.

Any content involving the sexual exploitation or abuse of children, child sexual abuse material, grooming, sexualisation of minors or any other form of child exploitation is strictly prohibited and may be reported to the appropriate authorities where required.

Users must not upload content that infringes another person's privacy, copyright, trade mark, intellectual property or other legal rights.

Prohibited Uses

Develop Jointly must not be used to harass other users, impersonate another person, misrepresent an identity, send spam, distribute malware, attempt to gain unauthorised access to another account or system, manipulate the platform, scrape user information, or interfere with the proper operation of the service.

Users must not use the app to promote illegal activity, fraudulent schemes, deceptive conduct, scams, unlawful financial arrangements or any activity that may place another person at risk.

Users must not use another member's contact information for unrelated marketing, solicitation, harassment or any purpose that the member has not reasonably agreed to.

Reporting, Blocking and Moderation

Develop Jointly provides tools that allow users to report inappropriate behaviour or content and to block other users where appropriate.

We may review reports, investigate activity and take action that we reasonably consider necessary to protect users, enforce these Terms or maintain the integrity and safety of the platform.

Users should use reporting features honestly. Deliberately false, malicious or abusive reporting may itself be treated as a breach of these Terms.

Enforcement and Account Action

Develop Jointly reserves the right to act swiftly when a user breaches these Terms of Use, threatens the safety of another person, misuses the platform or otherwise engages in conduct that we reasonably consider inappropriate or harmful.

Depending on the seriousness and circumstances of the conduct, we may remove content, restrict features, issue warnings, temporarily suspend or ban an account, prevent a user from interacting with others, or permanently delete an account.

Serious conduct may result in immediate action without a prior warning. Where required by law, we may also preserve or disclose relevant information to law-enforcement authorities or other appropriate bodies.

No Financial Advice

Develop Jointly is not a financial adviser, investment adviser, mortgage broker, accountant, tax adviser or financial services provider. Nothing displayed, communicated or made available through the app constitutes financial, investment, lending, tax or accounting advice.

Develop Jointly does not recommend that any user invest money, borrow money, purchase land, construct a building, enter into a joint venture or proceed with any particular property development.

Any figures, discussions, opinions, examples or information shared by users through the app are not representations or guarantees made by Develop Jointly.

Property Development Involves Risk

Purchasing property, constructing buildings, developing land, borrowing money and participating in a joint development venture can involve substantial financial, legal, construction and commercial risk.

There is no guarantee that a development will be completed, that finance will be available, that costs will remain within budget, that approvals will be obtained, that property values will rise or that any user will make a profit.

A user may lose some or all of the money they commit to a project. Every user is responsible for understanding and accepting the risks of any decision they make.

Your Own Due Diligence

Every user must conduct their own independent due diligence before entering into any development, construction arrangement, property transaction, loan, group arrangement or other venture.

Users should obtain independent professional advice where appropriate, including legal, financial, tax, lending, planning, engineering, building and other specialist advice relevant to their circumstances.

Users are responsible for checking the identity, experience, qualifications, financial position, intentions and reliability of people they meet through the app before entering into any arrangement with them.

Builders, Professionals and Referrals

Develop Jointly may provide features that allow a user to request contact with a builder or other professional. Any referral or introduction is intended to facilitate contact only.

A builder, solicitor, adviser, contractor or other third party is independent from Develop Jointly unless expressly stated otherwise. Develop Jointly does not control the services they provide, the advice they give, the prices they charge, the contracts they offer or the outcome of work performed by them.

Users are responsible for deciding whether a builder, professional or service provider is suitable for their needs and should carry out their own checks before entering into any agreement.

Referrals

When a group is ready to move forward with a proposed development, any member of that group may choose to use the red “Refer to Builder” button in Develop Jointly to request an introduction to one of the builders we work with. Using this feature is entirely optional and does not require the group to engage, contract with or build with the referred builder.

If the group decides, in its own discretion, to enter into a building contract with a referred builder and the referral results in a successful project for that builder, the builder may pay Develop Jointly a referral fee for providing the successful introduction. Any such referral fee is paid by the builder to Develop Jointly and does not make Develop Jointly a party to the building contract or the development.

Develop Jointly does not take part in the construction process and does not manage, supervise or control the project. We do not make construction decisions, approve work, manage project funds, administer building contracts or direct the builder. Our role is limited to providing a platform through which people can connect, communicate, form groups and, if they choose, request an introduction to one of our builders.

Our Builders

Develop Jointly seeks to work with established volume builders that also have the capability to undertake custom homes, townhouses, units and other suitable development projects. We have chosen this approach because large-volume builders generally purchase significant quantities of materials, fixtures and other building inputs and can benefit from economies of scale.

A volume builder may complete a large number of projects each year. That scale can allow the builder to negotiate competitive supplier pricing, maintain established construction systems and spread operating costs across a larger number of builds. For users seeking a custom development, this can provide access to the capabilities of a large builder while still allowing the project to be designed for the group's particular site and requirements.

Our aim is to refer users to large, experienced and reputable builders that we believe can offer strong value, competitive pricing and the capacity to deliver custom projects at scale. However, builders remain independent third parties, prices and services will vary from project to project, and every group must decide for itself whether a particular builder, quotation and building contract are suitable for its needs.

Groups and Arrangements Between Users

Develop Jointly provides tools that allow users to meet, communicate and form groups. Develop Jointly is not a party to agreements made between users simply because those users met or communicated through the app.

Users are responsible for documenting their own arrangements, deciding how money or responsibilities will be managed and obtaining any independent legal or professional advice they consider necessary.

Develop Jointly does not hold or manage money for users under these Terms and does not guarantee the conduct, performance, honesty, solvency or reliability of another app user.

User Content and Responsibility

Users remain responsible for the content they create or upload and must have the right to provide that content through the app.

By uploading content, a user gives Develop Jointly permission to store, process and display that content to the extent reasonably necessary to operate the features of the app in which the user chose to provide it.

Develop Jointly may remove or restrict access to content that breaches these Terms, infringes another person's rights, creates a safety concern or is otherwise inappropriate for the platform.

Account Security

Users are responsible for protecting access to their account and should not knowingly allow another person to misuse their account.

If a user believes their account has been compromised or used without permission, they should take appropriate steps to secure it and contact Develop Jointly where assistance is required.

Availability of the Service

We aim to keep Develop Jointly available and operating reliably, but we do not guarantee that the app will always be available, uninterrupted, error-free or free from technical problems.

Features may be changed, suspended, restricted or discontinued where reasonably necessary for maintenance, security, legal compliance, product improvement or other operational reasons.

No Guarantee About Other Users

Develop Jointly does not guarantee that information provided by another user is accurate, complete or truthful and does not guarantee the identity, intentions, experience, financial capacity or reliability of another user.

Users should exercise appropriate judgment when communicating with people they meet through the app and should not rely solely on statements made through Develop Jointly when making important financial, legal or property decisions.

Responsibility and Liability

To the maximum extent permitted by applicable law, users are responsible for the decisions they make, the people they choose to deal with and the agreements or developments they choose to participate in.

Develop Jointly is a platform for communication and networking. We are not responsible for losses arising solely from a user's decision to enter into a property, construction, financial or commercial arrangement with another user or independent third party.

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under applicable law.

Changes to These Terms

We may update these Terms of Use when the app, its features, our policies or applicable legal requirements change.

When material changes are made, the updated Terms will be made available through the app and, where appropriate, users may be asked to review or accept the revised Terms before continuing to use particular features.

Important

Develop Jointly helps people meet and communicate. It does not make investment decisions for users, guarantee financial returns or remove the risks associated with property and construction development. Always conduct your own due diligence before proceeding with any venture.
